In case the Form I-864, Affidavit of Support was signed or you are only planning to do that, it is essential to realize the connected responsibilities and the time when they end.
As for Form I-864, it is a contract between the U.S. government and yourself, where you give your promise to support the potential immigrants if they are unable to do this now or in the future. At least one of several possible criteria have to take place for your responsibilities under Form I-864 could end.
Liabilities of the Sponsor Under Form I-864
Form I-864, Affidavit of Support, is a lawfully implementable contract. In this case both the government and the immigrant who is sponsored have a possibility to take the sponsor to court if the sponsor can't provide appropriate support to the potential immigrant. Additionally, there's a possibility for the immigrant to leave his job and sue the sponsor for the support provided. Consequently, it is extremely important to trust the potential immigrant.
If public benefits were provided to the potential immigrant by any public agencies during the agreement term, the sponsor can be sued by the government for reimbursement. And again, the immigrant is able to sue the sponsor to get the sufficient amount of money to bring the income up to 125% of the sum listed in the United States Government’s Poverty Guidelines (as you can see in the chart in Form I-864P).

Criteria That Terminates Obligation
Your liabilities under Form I-864, Affidavit of Support, will end if an individual who becomes a legal inhabitant based on that affidavit:
- Becomes a citizen of the United States;
- Has worked, or is able to get credit for, 40 quarters of coverage under the Social Security Act;
- Does not have legal permanent status any longer and has left the United States;
- Is subject to removal, but applies for and gets, in remove proceedings, a new grant of adjustment of status, based on a new affidavit of support, if there is a need in one; or
- Passes away.
Marriage dissolution
You could have noticed that marriage dissolution is not an event that abdicates the responsibility for the potential immigrant under Form I-864. What about the sponsor? He or she is still responsible for the spouse of the immigrant, even after their marriage dissolution. Click here for further information
